In 2020, our law firm was involved in the process of acquiring a property developed with a shopping center, located in the center of a mid-sized city in Śląsk, on behalf of our client.
We conducted a thorough legal examination of the property, including the land itself as well as the lease agreements concluded with tenants. We provided advice on drafting the property acquisition agreements and participated in negotiations concerning these agreements.
The specificity of this transaction lay in the fact that the property was co-owned by two partners of a civil partnership, and the investor was set to acquire half of the property. Therefore, it was necessary not only to determine the terms of the acquisition but also to establish how the property would function as co-ownership afterward, including the division of profits and ongoing revenues from this investment. As a result, the Investment Agreement was quite complex, but thanks to our involvement, we successfully regulated the terms of cooperation in a manner most beneficial for the co-owners.
