Our client, the owner of an undeveloped property, planned to begin a construction investment on the site. However, the municipality, by introducing the Local Spatial Development Plan (MPZP), excluded this area from development, designating it as green space. This decision effectively blocked the possibility of carrying out the planned investment.
After a detailed analysis of the situation, we developed a strategy of action for the client and took legal steps that led to the revocation of the provisions of the Local Spatial Development Plan concerning their plots. We first convinced the Provincial Administrative Court, and then the Supreme Administrative Court, that the restrictions on development introduced by the municipality in this area were unlawful and unjustifiably limited property rights.
Thanks to the dedication of our lawyers and effective representation before administrative courts, we succeeded in overturning the unfavorable provisions of the MPZP. The client regained full rights to manage their property in accordance with the original plans. They are now in the project design phase and will soon begin construction.
