In 2024, we advised a client—the owner of a property housing a three-star hotel with 70 rooms, a restaurant, a fitness center, and a fully operational hotel infrastructure.
An international hotel chain was interested in taking over the management of this hotel. The negotiations covered the terms of the lease agreement and the conditions for transferring the entire hotel property into the possession and operation of the new operator, including the right to brand the property with its own trademark. The lease term was set for 30 years.
The most challenging part of the lease negotiations was determining the scope of responsibilities for the property and properly distributing liability between the parties regarding defects and faults in such a complex property.
With our support, the client signed an agreement ensuring financial stability and legal security for the next 30 years. The new operator was able to take over the hotel’s management without obstacles, while the client has the assurance that their interests are well protected. A clear division of responsibility for the property minimized the risk of future disputes.
